California Comprehensive Compliance Program

Annual Declaration for Purposes of California Health and Safety Code, §§ 119400-119402
Bavarian Nordic Inc. (“Bavarian Nordic US”), a subsidiary of Bavarian Nordic A/S (“Bavarian Nordic”) declares that it is, to the best of its knowledge and based on its understanding of the relevant statutory requirements, in substantial compliance with its Comprehensive Compliance Program (“CCP”) and Cal. Health & Safety Code §§ 119400-402. The Bavarian Nordic US CCP contains the elements of an effective compliance program identified in the "Compliance Program Guidance for Pharmaceutical Manufacturers", a publication issued by the Office of the Inspector General, U.S. Department of Health and Human Services in April 2003 which identifies important elements of a compliance program but gives broad discretion to manufacturers in the development and design of the compliance program. Bavarian Nordic also follows the "Code on Interactions with Healthcare Professionals" published by Pharmaceutical Research and Manufacturers of America (the "PhRMA Code").
